    Why Essex Leaseholders Are Buying Out Their Freeholder

    A lot of Essex's newer commuter-belt developments were sold with escalating ground rent clauses : the kind that double every 10 or 15 years. The freeholder is often the housebuilder's investment arm, holding onto the ground rent income long after the last flat was sold.

    Collective enfranchisement : often just called "buying the freehold" lets leaseholders end that arrangement for good. Leaseholders form a company, that company buys the freehold, and ground rent effectively stops from then on. The freeholder can't refuse a valid claim; only the price is negotiable, with a tribunal as backstop if agreement can't be reached.

    To qualify

    2+ your building needs at least two flats
    at least two-thirds of them held on long leases
    ½ leaseholders owning at least half of all the flats need to join the claim

    1. Our lease has a doubling ground rent clause , does buying the freehold fix that?

    Yes. Once your company owns the freehold, ground rent effectively stops for participating leaseholders, regardless of what the original lease said.

    2. Our freeholder is our housebuilder's management arm, can we still force a sale?

    Yes. It doesn't matter who the freeholder is. If your building meets the eligibility criteria, they can't refuse a valid claim : only the price is negotiable.

    3. How much does it cost to buy the freehold?

    It depends on your building's value, ground rent levels, and lease lengths. Recent reform has removed some of the largest cost items for many buildings. We give you a clear breakdown before you commit to anything.

    4. How long does the process take?

    Realistically 12 to 18 months for most Essex blocks, mostly down to statutory notice periods and valuation. We track every deadline so nothing slips.

    5. What happens once we own the freehold?

    Your company owns the building. Most leaseholder groups then appoint a professional, RICS-regulated managing agent : like us : to run it day to day.
