    Right To Manage For Essex's New-Build And Retirement Developments

    Most of the RTM enquiries we get from Essex come from a specific pattern: newer commuter-belt developments built since the 2000s, or over-55s retirement schemes, where the freeholder is a housebuilder's management arm rather than a person you can actually reach.     1. My freeholder is a housebuilder's management company, not a person, does RTM still apply?

    Yes. It makes no difference whether your freeholder is a housebuilder's management arm, an investment fund, or an individual. If your building meets the eligibility criteria, the right to manage applies the same way.

    2. We're in an over-55s retirement development - can we still use Right to Manage?

    In most cases, yes, provided the building is self-contained and meets the standard leasehold and flat-count criteria. Some retirement schemes have extra points to check, which we'll flag during your free eligibility review.

    3. Do I need to prove my freeholder did something wrong?

    No. Right to Manage is a no-fault legal right. You don't need a reason - your building just needs to qualify.
